Competitive Contracting Basics for the Ontario Broader Public Sector

This online, self-directed course provides an overview of the new Ontario Broader Public Sector Accountability Act, and in particular, the associated Procurement Directive.  After a high-level overview, the course turns to some of the key obligations under the new legislation, including the enhanced requirements for conducting an open and transparent competitive process for significant procurements, providing a debriefing opportunity for unsuccessful vendors as well as the requirement for a bid dispute resolution process.

Following this introduction to the new legislation and its implications, the course then provides learners with a comprehensive review of the critical court decisions that have shaped the legal obligations for those conducting an RFP, ITT or other competitive contracting process, and examines each of the obligations in detail.

Participants will learn how to sort out the ‘alphabet soup’ of contracting, explaining the various acronyms and describing how each of the key competitive contracting methods can be used most effectively. They will explore the concept of prequalification through real life examples where market assessment and vendor screening have created huge value for the subsequent procurement process, while dramatically reducing legal risk.

At the conclusion of the course, we return to a discussion of the Accountability Act and Procurement Directive, and provide suggestions for further reading and resources.
